Job DescriptionJOB SUMMARY


The role of Chief Compliance Officer (CCO) for Bci Securities, the Broker-Dealer (BD) and Registered Investment Advisor (RIA), will report to the Chief Executive Officer of the broker dealer, and indirectly report to the Head of Wealth Management and Board of Directors between both entities. Responsibilities include regulatory compliance with the above firms. The CCO will also be responsible for collaborating with global teams, specifically in Latin America.

DUTIES OF THE POSITION


The duties of the position include, but are not limited to, the following:


  • Establish, maintain and upgrade standards and procedures that are effective in identifying, preventing, detecting and remediating regulatory issues.

  • Chaperone agreements between the entities and BCI Securities – Miami.

  • Continually assess the inherent risk of business units as well as the effectiveness of mitigating controls to minimize the residual risk of reputational damage, regulatory consequences and other operational risks.

  • Oversee and manage the compliance program functions for the BD and IRA, including implementation of written supervisory procedures, transaction monitoring, AML compliance (FINRA Rule 3310), training and annual testing.

  • Manage the licensing requirements and holdings for the BD, and IRA.

  • Manage regulatory interactions, prepare submissions and coordinate responses to inquiries from regulatory authorities.

  • Support compliance efforts related to supervisory oversight, training, e-mail surveillance, branch office exams, FINRA licensing and registrations, anti-money laundering supervision, and advertising.

  • Work with senior management, Legal, Compliance, HR, Marketing, registered representatives, and other key constituencies to train, promote and enhance a culture that encourages ethical conduct and a commitment to compliance with applicable laws and regulations.

  • Provide advice on MSRB, FINRA, and SEC rules, regulations and interpretive guidance, as well as applicable internal policies and procedures.

  • Keeping abreast of AML rules, regulations, and requirements by reviewing reading materials, Web site resources, and other third party materials dealing with money laundering issues and anti-money laundering efforts and reviewing PATRIOT Act Section 311 Special Measures for jurisdictions, financial institutions, or international transactions of primary money laundering concern (available at https://www.finen.gov/resources/statues-regulations.311-special-measures).

  • Obtaining required Foreign Bank Certifications.

  • Ensuring that SARs, CTRs, and CIMRs are filed promptly and on time.

  • Review and approve political contribution requests, sponsorship requests, bond ballot contributions, and quarterly MSRB G-37 filing.

  • Assist with the supervision of sales-related activities.

  • Mange KYC process on new customers, enforce accurate review of OFAC searches.

  • Integrate industry benchmarking and best practices through ongoing research, education, and industry affiliations

  • Demonstrate ability to effectively review and analyze complex situations and apply judgment to resolve issues in a timely manner with minimal supervision.

  • Must be proficient in time management and able to initiate and manage projects.

  • Ability to recruit, lead and manage a staff to achieve the above objectives and promote a culture of collaboration and objectivity.

  • Ability to understand, speak, read and write English and Spanish

  • Effectively speaking before groups of customers or employees

  • Assume evolving duties and responsibilities of position

  • Work all hours required to fulfill job duties and responsibilities (including, weekends, evenings and holidays as needed)

  • Travel as required

  • Provide coverage for other positions as requested

  • Ability to carry and lift boxes and objects that may weigh between 10 and 25 pounds.

  • Perform additional duties and responsibilities as assigned by management


COMPLIANCE RESPONSIBILITIES


In the performance of their duties, all Bci - Miami Branch staff members are required to comply all state and federal regulatory and legal requirements, including the Bank Secrecy Act, the Federal Election Campaign Act of 1979, the Foreign Corrupt Practices Act, and the Bank Bribery Amendments Act. Additionally, all staff members must comply with in the Bci’s Personnel Manual and Code of Ethics and other policies of Bci which are either currently in place or which may become effective during the staff member’s employment.

PRE-HIRE REQUIREMENTS FOR THIS POSITION:


COMPUTER:

Ability to operate IBM compatible personal computers; fluency with Microsoft Word, Microsoft Excel, Microsoft PowerPoint and


EDUCATION:

Bachelor’s Degree and advanced degree preferred


CERTIFICATIONS/LICENSES:

  • Certification in Anti-Money Laundering or comparable work experience.

  • Compliance Officer Securities License Series

  • Broker-Dealer General Sales Principal and Supervisory License Series.


EXPERIENCE:

  • Minimum 10 years of experience working in a senior compliance role (CCO or similar) within a financial services firm supporting a Broker Dealer and/or RIA.

  • Experience working with regulatory agencies and legal teams, both internal and external.

  • Experience with US Anti-Money Laundering regulations and best practices.

  • Additionally, this individual will have prior experience on FINRA regulations, and knowledge of the parameters involved in the Maintaining Qualifications Program (MQP).
