Poliakoff Backer’s community association attorneys provide quality, customized representation to condominium, HOA, and master/country club communities of all sizes throughout South Florida (including St. Lucie, Palm Beach, Broward, and Miami-Dade Counties). The role centers on proactive counsel, practical risk-spotting in governing documents, and responsive day-to-day legal guidance—delivered with the firm’s hallmark of personal service, continuity, and accessibility.
Core Responsibilities
- Serve as general counsel to boards and managers on operational, governance, and compliance matters.
- Interpret, draft, and update governing documents (declarations, bylaws, rules, policies) and advise on amendments and risk reduction. Poliakoff Backer+2Poliakoff Backer+2
- Guide associations on covenant/rule enforcement strategy, compliance, and owner-facing dispute resolution.
- Draft, review, and negotiate vendor and contractor agreements and advise on risk allocation and practical contract protections.
- Manage or support litigation/mediation and contested matters as needed (including enforcement and collections disputes). Poliakoff Backer+2Poliakoff Backer+2
- Provide timely guidance on statutory/regulatory compliance, including fair housing considerations and risk mitigation for age-restricted communities.
- Communicate efficiently and transparently with clients, using firm tools and client education resources (including newsletters and technology platforms).

Substantive Legal Competencies:
- Strong command of Florida condominium/HOA governance concepts, document interpretation, and association operations.
- Drafting excellence for amendments, enforcement letters, policies/rules, and contracts.
- Working knowledge of collections enforcement workflows and client status/reporting expectations.
- Sound judgment for dispute resolution, escalation, and litigation oversight when necessary.
Technology & Process:
- Ability to use (and help clients benefit from) the firm’s technology-forward communication and collections systems and related reporting tools.
Minimum Qualifications
- J.D. from an accredited law school
- Active member in good standing with The Florida Bar
- Demonstrated experience representing condominium associations and/or HOAs in general counsel, enforcement, collections, document drafting, and/or community association disputes. Please do not apply if you do not have this experience.
